P3S – Terms of Use

P3S by Platinum 3Sixty | Version 1.0 | Effective 3 November 2026

1. Who we are

P3S is provided by Platinum 3Sixty Ltd ("we", "us", "our"), a company registered in England and Wales with company number 11592029. Our trading address is Bullockstone Road, Herne Bay, Kent CT6 7NL, England. Our director is Jake Leyser.

You can contact us at enquiries@p3s.app. Our website is https://p3s.app and the app is at https://app.platinum3sixty.com.

2. About these terms

These terms are an agreement between us and the company or business that signs up to use P3S ("you" or the "customer"). The person who accepts these terms on behalf of the customer confirms they have authority to do so.

P3S is a business service for contractors. It is not intended for use by consumers. If you have signed an order form or chosen a plan, that order form or plan forms part of these terms. If there is a conflict, the order form or plan wins.

Our Privacy Notice explains how personal information is handled. The Data Processing Schedule at the end of these terms forms part of these terms.

3. The service

P3S is a web app (which can be installed on a phone or tablet like an app) for highway, surfacing and reinstatement contractors. Depending on your plan, it includes:

Some features use third-party services, such as map tiles from OpenStreetMap and Esri, optional what3words three-word addresses, and Google Maps links for directions. Those services are provided by their owners and may have their own terms.

We may improve, change or remove features from time to time. We will not make changes that substantially reduce the core service during a paid term without telling you first.

7. Acceptable use

You and your users must not:

8. Your data

9. Our intellectual property and your licence

We (or our licensors) own P3S, including its software, design, content, the P3S and Platinum 3Sixty names and logos. While these terms are in force, we give you a non-exclusive, non-transferable right for your users to use P3S for your own business. You get no other rights in P3S.

If you send us suggestions or feedback, we may use them freely to improve P3S.

10. Availability and support

11. Safety – the app supports, it does not replace

P3S is a tool to help you organise and record your work. It does not replace your own safety management system, your competent persons or your legal duties. In particular:

12. Estimates, weather and location accuracy

13. Liability

What we do not limit. Nothing in these terms limits or excludes liability for death or personal injury caused by negligence, for fraud or fraudulent misrepresentation, or for anything else that cannot be limited or excluded by law.

Losses we are not responsible for. We are not liable for loss of profit, revenue, business, contracts or goodwill, for loss or corruption of data (beyond restoring from our latest available backup), or for any indirect or consequential loss.

Our maximum liability. Our total liability to you under or in connection with these terms in any 12-month period is limited to the fees you paid us for P3S in the 12 months before the event giving rise to the claim. During a free trial, our total liability is limited to £100.

Except as set out in these terms, all other warranties and conditions are excluded to the extent the law allows.

14. Suspension and ending the service

15. Changes to these terms

We may update these terms from time to time. We will tell you about important changes by email or in the app at least 30 days before they take effect, unless the change is needed sooner for legal or security reasons. If you do not agree, you can stop using P3S before the change takes effect.

16. General

17. Governing law

These terms are governed by the law of England and Wales, and the courts of England and Wales have jurisdiction over any dispute.

For customers in Australia: nothing in these terms excludes, restricts or changes any right or remedy you have under the Australian Consumer Law (or any other law) that cannot lawfully be excluded, restricted or changed. Where our liability for failing to meet such a guarantee can be limited, it is limited (at our choice) to supplying the service again or paying the cost of having it supplied again.

Schedule – Data Processing

This schedule applies where we process personal information on your behalf as part of P3S. It is intended to meet the requirements of the UK GDPR and the Data Protection Act 2018 and, for Australian customers, to support your obligations under the Privacy Act 1988 (Cth) and the Australian Privacy Principles.

A. Roles and details

B. Our commitments

  1. Instructions. We will process personal information only on your documented instructions (which include these terms and your use of P3S's settings), unless the law requires otherwise. We will tell you if we think an instruction breaks data protection law.
  2. Confidentiality. Anyone we allow to access the information is bound by a duty of confidentiality.
  3. Security. We will take appropriate technical and organisational measures to protect the information, including access controls so each company only sees its own data, encrypted connections, encryption at rest by our database host, sign-in links sent by email and regular backups.
  4. Sub-processors. You agree to us using the sub-processors listed below. We will tell you before adding or replacing a sub-processor, so you can object. We will put a written contract in place with each sub-processor giving equivalent protection, and we remain responsible for them.
  5. Rights requests. We will help you, as far as reasonably possible, to respond to requests from people exercising their data protection rights, and pass on to you any request we receive directly.
  6. Other help. We will give you reasonable help with security, breach notifications, data protection impact assessments and consultations with regulators.
  7. Breaches. We will tell you without undue delay after becoming aware of a personal data breach affecting your information, and give you the details you reasonably need.
  8. End of service. At the end of the service we will, at your choice, return (export) or delete the information, as set out in section 14, unless the law requires us to keep it.
  9. Audits. We will make available the information reasonably needed to show we meet this schedule, and allow audits or inspections by you or your auditor on reasonable notice, at reasonable times and subject to confidentiality.
  10. International transfers. We will only transfer personal information outside the UK where there is an adequacy decision or appropriate safeguards are in place, such as the UK International Data Transfer Agreement or the UK Addendum to the EU Standard Contractual Clauses.
